Mumbai: The sessions court, Dindoshi, has convicted 31-year-old Mohammad Firoz Khan for assaulting his roommate with a pair of scissors, causing his death in April 2019. The man has been sentenced to life imprisonment.

About The Case

As per the prosecution's case, Khan used to sleep at a workshop owned by Gulam Rasul Ansari, the owner of the Teghi Tyre Services. Along with Khan, Ansari's two employees, Tanveer Mohammad Shaikh, used to sleep at the workshop. It was alleged that Khan used to take drugs and would often come to the room under an inebriated condition. On April 10, 2019, the accused came to the room late.

Shaikh took objection to taking the accused in, and there was a quarrel. Later, the accused reached to police station and the matter was solved. At around 6.30 am, the accused came to the room angrily and attacked Khan with a pair of scissors. Shaikh fell due to injuries and was unconscious. Later, Khan was declared dead on arrival at the hospital.

The court observed, “The totality of the facts as proved on the record will show that Tanveer Shaikh was sleeping when the accused had entered the Teghi Tyres and Service Center. It has also been proved that the accused had then taken a pair of scissors from the said workshop and assaulted Tanveer on his chest with the same twice, to the extent that he caused an injury to Tanveer’s trachea, heart, and one lung. This will reflect the fact that the injuries are being caused to the vital parts of his body. The same resulted in his almost instantaneous death.”

"These facts will, in my opinion, clearly prove that no provocation whatsoever had been given to the accused by the deceased. Hence, there was no reason for the accused to lose his cool and then assault the deceased," the court added.
