Navi Mumbai News: NMMC Lists 2,111 Buildings Occupied Without OC, Warns Of Action For Non-Compliance

The action comes in response to orders passed by the Bombay High Court in PIL No. 24/2019 and Writ Petition No. 13864/2018. In its directive dated October 25, 2024, the High Court instructed NMMC to submit details of such non-compliant structures within its jurisdiction.

The Navi Mumbai Municipal Corporation (NMMC) has published a list of 2,111 buildings and housing societies that have begun occupancy without obtaining the mandatory Occupancy Certificate (OC). These buildings had received Commencement Certificates but were found to be in use without legal approval for occupation, which violates building regulations.

The action comes in response to orders passed by the Bombay High Court in PIL No. 24/2019 and Writ Petition No. 13864/2018. In its directive dated October 25, 2024, the High Court instructed NMMC to submit details of such non-compliant structures within its jurisdiction. Following this, all eight divisional offices under NMMC conducted surveys and submitted reports identifying the violations.

As per the directive, NMMC has made the list of these buildings publicly accessible on its official website — www.nmmc.gov.in — and at all municipal divisional offices.

According to the civic body, occupying a building without an OC is against building norms, and residents of these 2,111 structures have been urged to immediately apply for the Occupancy Certificate by submitting the required proposal to the Town Planning Department.

NMMC has clarified that failure to obtain the certificate may attract penal action under the Maharashtra Regional and Town Planning Act, 1966. The civic body has also stated that designated officers will initiate action against violators if the necessary compliance is not achieved.

"We aim to ensure structural safety, legality, and proper civic service provisioning to all residents while reinforcing adherence to urban planning norms, hence the list has been published. We appeal compliance from those who still do not have OC," a NMMC officer said.
