Mumbai Police Grants Permission For CPI(M) 'Peaceful Assembly' At Azad Maidan On Gaza Issue On August 20

The Mumbai Police on Monday informed the Bombay High Court that permission will be granted to the Communist Party of India (Marxist) [CPI(M)] to hold a “peaceful assembly” at Azad Maidan in South Mumbai on August 20. This protest is aimed at expressing concerns over the alleged genocide occurring in Gaza.

The court was hearing a petition filed by CPI(M) challenging the refusal of permission by the police to hold a demonstration citing law and order situation. 

Assembly to Be Held Between 3 PM and 6 PM Under Strict Guideline

Pursuant to the statement by the public prosecutor SV Gavand, petitioner’s counsel, senior advocate Mihir Desai, said that they will hold the peaceful assembly between 3pm to 6pm. 

A bench of Justices Ravindra Ghuge and Gautam Ankhad had previously raised concerns about inflammatory speeches and potential disruptions during the protest. “What assurance are you giving regarding no inflammatory speeches?” the bench asked. 

Desai assured the court that the meeting would be peaceful and the organisers would adhere to Draft regulations for public meetings, agitations and processions proposed under the Maharashtra Police Act. 

As per the draft rules, public meetings such as this can be held only in a designated area of Azad Maidan. The rules further prescribe that organisers are responsible for ensuring that the protest is peaceful and does not adversely impact law and order.

Court Previously Criticised Party’s Focus on International Issues

The petition was filed after the police had initially refused permission for the protest, citing concerns that the demonstration could spark a law and order issue, as it was perceived to challenge India’s foreign policy. CPI(M) argued that citizens have the constitutional right to protest at designated spots, even on issues that may not align with government policies. Desai emphasised that while the protest was against the situation in Gaza, it would remain peaceful.

Earlier, the HC had dismissed a petition by CPI(M) while  criticised the party for focusing on international issues instead of addressing domestic concerns. “You are looking at Gaza and Palestine. Look at your own country. Be patriots,” the court had remarked on July 25, urging the party to focus on national issues.
