Indore (Madhya Pradesh): In a crucial step towards stopping development of illegal colonies in the district, ensure compliance with legal provisions and prevent problems for the general public due to notarization of immovable property, the district administration on Thursday imposed a ban on the sale of plots (immovable property) on notary (notarization of the sale documents).

Collector Asheesh Singh issued the prohibitory orders of this regard on Thursday. As per the order, notarization of immovable property worth Rs 100 and above is prohibited in the district.

If such an act is done by any notary, action will be taken against him under Section 223 of the Indian Code of Justice, 2023, along with recommending action to cancel the notary’s license.

All senior district registrars, district registrars, senior deputy registrars, deputy registrars, SDMs, executive magistrates, police station in-charges and senior police officers will ensure compliance with and implementation of the order.

Any person or organization that violates the order will be prosecuted under the penal provisions of Section 223 of the Indian Code of Justice, 2023. This order will remain effective from August 7 to October 5, 2025.

Official sources said that it was often seen that some people bought and sold immovable property on the basis of notary instead of buying and selling it on the basis of registry.

In this type of fraud, naive people who did not know the rules and regulations got trapped and became victims of fraud, facing problems later. Unnecessary difficulties arose due to the non-existence of any legal authority for such documents registered through notarization.

It was often seen that people purchased immovable property with their entire life’s earnings or loan etc. But to save money, they bought it through notarization without getting it duly registered, the basis of notary, due to which the government suffered revenue loss.

On the other hand, due to the non-existence of relevant documents, no ownership of the buyer was determined. Along with this, it promoted illegal colonies, where a situation of public outrage is created due to the absence of any kind of infrastructure. Also, due to the increase in legal disputes related to ownership, there were apprehensions of law and order problems.
