RCB Moves High Court Against CAT Remarks Blaming Franchise For Bengaluru Victory Stampede

In its Objection Petition, the RCB has contended that the RCB was not a respondent in the petition filed by the IPS officer and no notice was served to RCB with respect to the petition.

Bengaluru: The RCB franchise management has approached the Karnataka High Court against the opinion of the Central Administration Tribunal, holding RCB responsible for the stampede, while delivering judgement with respect to the application made by IPS officer Vikas Kumar.

In its Objection Petition, the RCB has contended that the RCB was not a respondent in the petition filed by the IPS officer and no notice was served to RCB with respect to the petition.

However, without issuing a notice and not hearing the argument of the company, the CAT had held RCB responsible for the stampede.

Stating that the ex-parte decision and the comments against the RCB were against the principles of natural justice and prayed before the Court to direct the CAT to expunge its comments and opinion.

On June 5, the State government had suspended Vikas Kumar on the charges of dereliction of duty during RCB victory ceremony, where a stampede near the Chinnaswamy stadium. While revoking the suspension order, the CAT had pointed out that the RCB, without police permission had organised the victory procession and had invited people through social media, which led to the stampede.

HIGH COURT: Meanwhile, the Karnataka High Court has directed the Karnataka government to restrain from submitting the final report of the investigations pertaining to FIRs filed by the Cubbon Park police, without prior permission of the court.

Soon after the stampede, the Cubbon Park police had filed FIRs against Karnataka State Cricket Association, RCB and DNA Entertainment Network. All the three organisations had approached the Karnataka High Court for quashing the FIRs.

After hearing the argument from all the three parties, Single Judge in the Karnataka High Court Justice S R Krishna Kumar noted that submitting the final report may cause adverse influence on the case. The court directed the government not to submit the final report to the court without the permission of the bench.
