Jabalpur High Court Asks Government, Seller, Buyer To Justify Ownership Of Prime Land In Sagar

Bhopal (Madhya Pradesh): Principal bench of Madhya Pradesh High Court at Jabalpur has instructed government, sellers and buyers to justify their claim of ownership of 27.82 acre of land located in prime location in Sagar.

Out of 30 acres of government land situated in front of Bhagyodaya Hospital, 27.82 acres were sold to Subhagyodaya Developers in 2017 by a family belonging to the minority community, claiming to be the owner of the land since 1963.

The Revenue Board Gwalior had granted permission to sell the said land on June 6, 2016, the seller family had claimed. However, the then Sagar collector had challenged the constitutionality of the sale permission order of the board.

Advocate Jagdev Singh Thakur filed an intervention application challenging the land ownership of the seller. Division bench of Chief Justice Suresh Kumar Kait and Vivek Kumar Jain heard all the writ appeals.

The High Court told the sellers that if they were given the land ownership rights of the said land, then it is their responsibility to prove it. It further said that if the revenue department had passed any order related to the land ownership rights, then it should be presented before the High Court. The court has asked the collector Sagar to file before the court if any order has been passed in connection with the said land.

Senior advocate Rameshwar Singh Thakur, who appeared on behalf of petitioner, told the court that the sellers neither received land ownership rights of the said disputed land nor do they have any legal right to sell it.

The sellers have claimed that they got the land ownership rights of the land in 1963, if they had got the land ownership rights, then why was permission taken from the revenue board to sell the said land, the advocate argued.
