Thane: The Thane Sessions Court has refused to grant bail to Kamlesh Gupta, a Bhayandar-based man arrested in March 2025 for allegedly assaulting a patrolling police constable with a knife — and doing so on two separate occasions during a single incident. The court ruled that the accused’s actions showed a clear intent to kill, making the offence serious in nature and unfit for bail.
The order was passed by Judge A.S. Bhagwat, who observed, “After careful perusal of the complaint, the prosecution’s statement, and the charge sheet, it appears there is a strong prima facie case against the applicant. He actively participated in a serious offence by assaulting a police constable on duty using a knife and delivering repeated blows. The police have also seized the weapon from the accused. The medical certificate confirms that the constable sustained grievous injuries. The repeated knife blows indicate the applicant’s intention to commit murder. Given the seriousness of the offence and the likelihood of the accused absconding, it would not be justifiable to grant him bail.”
According to the prosecution, Babu alias Kamlesh Gautam Gupta was arrested on March 15, 2025. On March 14, while a police constable was patrolling the area, he noticed Gupta and another person involved in a violent altercation with a third individual.
When the constable attempted to intervene, Gupta allegedly stabbed the officer twice in the abdomen with a knife. Despite the injury, the constable managed to escape the scene, even while still in possession of the weapon, and survived the attack.
Following the incident, a case was registered at Bhayandar Police Station, and Gupta was arrested the next day. The prosecution strongly opposed the bail plea, citing the brutality of the assault and the fact that the victim was a uniformed officer on duty.
The court accepted the prosecution’s argument and emphasized that such acts, especially against law enforcement officers, deserve no leniency at the bail stage.
