Thane MACT Awards ₹41 Lakh Compensation To 25-Year-Old Man Left 40% Disabled In 2011 Road Accident That Killed His Father

Over a decade after a horrific road accident claimed his father’s life and left him permanently disabled, 25-year-old Monesh Vijay Sutar has been awarded a compensation of Rs 41 lakh by the Thane Motor Accident Claims Tribunal (MACT).

Thane: Over a decade after a horrific road accident claimed his father’s life and left him permanently disabled, 25-year-old Monesh Vijay Sutar has been awarded a compensation of Rs 41 lakh by the Thane Motor Accident Claims Tribunal (MACT).

The accident occurred in 2011, when Monesh, then just 12 years old, was riding pillion on his father Vijaykumar Sutar’s motorcycle in Bhiwandi. A speeding trailer had lost control and rammed into their bike. Vijaykumar was killed on the spot, while Monesh suffered grievous injuries — including multiple pelvic fractures and a complete rupture of his urethra.

In its detailed order, MACT Member R.V. Mohite observed that the accident left Monesh with a 40% permanent physical disability, necessitating the lifelong use of a catheter. The tribunal noted that Monesh’s injuries robbed him not only of his childhood but also of the possibility of enjoying a normal adult life, including the prospects of marriage and parenthood.

“There are chances of repeated infection in the urethra and urinary bladder due to continuous use of a catheter. The claimant has to visit the doctor every month to change the catheter and treat infections if any,” the order stated. “He has lost the pleasures of marital life and will not be able to have children.”

Taking into account the pain, suffering, and permanent loss of amenities, the tribunal awarded Rs 6 lakh under this head. A sum of Rs 4 lakh was also awarded for the permanent disability, along with additional compensation for medical expenses, future treatment, and care.

The tribunal held both the trailer’s owner, Pradeepsingh Dalbir Singh, and its insurer, Shriram General Insurance Company Ltd., jointly and severally liable to pay the compensation. Of the Rs 41 lakh awarded, Rs 25 lakh is to be invested in a fixed deposit for five years in Monesh’s name, while the remaining will be released via cheque.
