A Dindoshi sessions court acquitted a woman and her alleged lover in the murder case of her husband due to lack of evidence. The court held that the prosecution failed to prove that Rubina Shaikh was residing with the deceased or that she had an extramarital affair.
The victim's father said that his son Nasim and Rubina were married in 2017. Due to frequent domestic quarrels, the duo moved into a rented accommodation in Sakinaka. The father claimed that in July 2022, he got a call from Nasim’s workplace, informing him that the latter had stopped coming to work without any intimation.
The father said that when he visited the couple's house, he did not find Nasim, but noticed a foul smell on the premises. He alleged that Nasim’s body was later found hidden inside the bed. The incident reportedly occurred on July 14, 2022, and the body was discovered four days later. The father then lodged a police complaint against Rubina and her alleged lover Mohammad Farooqi.
Nasim's family alleged that Rubina, with the help of Farooqi, killed Nasim. The prosecution argued that during the investigation, she confessed that murdered her husband as he assaulted her. However, during the trial, Rubina denied committing the murder and also denied having any relationship. The court, after considering all the evidence, noted that the father's testimony was hearsay. It observed that the body was found in the landlord’s house, who did not identify Rubina.
The court said that there was no cogent evidence to prove that the bed, in which the body was found, was in the exclusive possession of either accused. The prosecution failed to prove the 'last seen' theory, which would have ascertained who was with the victim just before he was killed, said the judge, adding that no motive was established either. Allegations of a love affair between Rubina and Farooqi were not supported by any witness or material evidence, it added, while pointing out the lack of forensic evidence.
