Mumbai: The Kherwadi police have registered a case against MHADA Vice President Sanjeev Jaiswal and 12 unidentified individuals for allegedly physically assaulting a former police officer (the complainant) and engaging in unlawful assembly.
Jaiswal reportedly slapped the complainant at the MHADA office, after which security staff and officers locked him in a room, assaulted him, and Jaiswal allegedly threatened to kill him. The case was filed on December 26, however, the police have yet to take action against the accused.
According to the FIR, the complainant, Vijay Chalake, 60, a retired assistant police officer residing in Andheri West, had previously lived in Mangalmurti Society, a building under MHADA (Maharashtra Housing and Area Development Authority) located in DN Nagar.
The building is undergoing redevelopment by MHADA. Since 2016, Chalake and 12 other families have not received their rent from MHADA. Chalake had filed a complaint with MHADA regarding the issue.
On December 26, Chalake and other family members visited the MHADA office to inquire about the pending rent. While waiting in the visiting room, Jaiswal arrived around 5 p.m. and informed them he would not come to the office again and asked the others to come later. When Chalake questioned this, Jaiswal allegedly became angry and slapped him.
Immediately afterwards, around 10 to 12 security staff and other staff arrived in the visiting room. They took Chalake to another room (Room No. 520) and locked the door from the inside. Four security guards reportedly held Chalake’s hands and legs while Jaiswal and others beat him with fists and kicks.
Jaiswal allegedly threatened Chalake, saying he would inform the Commissioner of Police, have him killed in an encounter, and stop his pension. The accused also reportedly broke Chalake’s gold chain and earphones.
The police soon arrived at the scene and took Chalake to V.N. Desai Hospital in Santacruz East for treatment. Following this, Chalake filed a complaint against Jaiswal and 12 unidentified individuals.
The police subsequently registered a case under various sections of the Bharatiya Nyaya Sanhita, including 127 (2) (Wrongful confinement), 189 (2) (Unlawful assembly), 191 (1) (rioting), 135 (Assault or criminal force in attempt to wrongfully to confine a person), 115 (2) (Voluntarily causing hurt), 352 (Intentional insult with intent to provoke breach of peace), 351 (2), 351 (3) (Intentional insult with intent to provoke breach of peace), and 324 (4) (Mischief causing loss to Government or Local Authority).
