Badlapur Encounter Case: Supreme Court Hears State Government's Petition On Akshay Shinde's Custodial Death

Mumbai: After the death of Akshay Shinde, the main accused in the sexual abuse case of children in a school in Badlapur, in a police encounter, the High Court has directed to register a case against the concerned police, but it has not been complied with yet. The deadline for registering a case expired on Saturday and the state government has filed a petition in the Supreme Court against this order of the High Court.

Badlapur Sexual Assault Case

In Badlapur, Thane district, two girls were sexually abused, with school cleaner Akshay Shinde as the main suspect. Shinde died in a police encounter on September 23, 2024, while being transported from Taloja jail to Kalyan, prompting allegations of a fake encounter and leading to the formation of a Special Investigation Team (SIT) to investigate.

The Bombay High Court ordered the registration of a case against the involved police officers on April 7, with a deadline of May 3 for compliance. As this deadline lapsed without action, the state government filed a petition in the Supreme Court against the High Court's directive, with a hearing set for May 5.

No case registered against the police yet

The Bombay High Court had on April 7 ordered a case to be registered against the police officers responsible for the Akshay Shinde encounter case. However, the state government has filed a petition in the Supreme Court against this order of the High Court. This petition will be heard today, May 5.

The government had previously sought additional time to transfer the case investigation to the SIT, citing the Supreme Court petition, but the Supreme Court upheld the High Court's order. The High Court subsequently warned the government of contempt for failing to comply and mandated the SIT to register a case.

The government initially claimed a lack of complainants but eventually assured the court they would register a case against the five police officers implicated by the magistrate in the Shinde encounter by May 3.
