Bombay Scottish School Sexual Assault Case: POCSO Court Grants Bail To West Bengal Doctor Accused Of Aiding Ex-Teacher Bipasha Kumar

The doctor, who was arrested on July 18 and sent to judicial custody on July 23, was accused of prescribing anti-anxiety medication to the minor. The prosecution alleged that these drugs were misused by the teacher to coerce the student into a prolonged sexual relationship.

Mumbai: A special court in Mumbai, hearing cases under the Protection of Children from Sexual Offences (POCSO) Act, granted bail to a West Bengal-based doctor accused of assisting a former 40-year-old female teacher, Bipasha Kumar, in the alleged sexual exploitation of a 17-year-old male student at Bombay Scottish School in Mumbai.

The doctor, who was arrested on July 18 and sent to judicial custody on July 23, was accused of prescribing anti-anxiety medication to the minor. The prosecution alleged that these drugs were misused by the teacher to coerce the student into a prolonged sexual relationship. The teacher has denied all allegations, claiming the relationship was consensual.

Special Judge Sabina A Malik, in her bail order issued on Thursday, noted that the doctor was not the prime accused and that her custodial interrogation had been completed, reported Hindustan Times. The court observed that there was no further evidence to be recovered from her, and keeping her in custody would not serve any additional purpose as the trial is yet to begin.

Despite strong opposition from the prosecution and the survivor, the court granted bail on a personal bond of Rs 50,000 with solvent sureties. The boy, in a written statement, had expressed fear of harm or manipulation if the doctor were released, stating her presence would leave him in “perpetual fear.” However, the court imposed stringent bail conditions: the doctor is prohibited from contacting the survivor, tampering with evidence, or leaving Mumbai without prior court approval. Any breach of these conditions, the court warned, would result in immediate cancellation of bail.

Accused Teacher Gets Bail

This development follows the earlier bail granted to the teacher, who had been arrested under the POCSO Act, the Bharatiya Nyaya Sanhita (BNS), and the Juvenile Justice Act. The teacher allegedly lured the student to luxury hotels, gave him alcohol and pills, and engaged in repeated sexual encounters from January 2024 to February 2025.

In her defence, she claimed the First Information Report (FIR) was influenced by the boy’s mother and presented evidence such as affectionate texts, handwritten notes and a tattoo of her name on the boy’s body. The court, while granting her bail, noted the changed teacher-student relationship following her resignation in April 2024 and considered her role as a single mother of twins, one of whom has a medical condition.

Both the doctor and teacher continue to face serious charges. The court has clearly stated that any violation of bail conditions will result in immediate revocation of relief.
