MP Transfer Policy Released; Govt Employees Of 1st, 2nd & 3rd Grade Can Avail Transfer Only In These Special Circumstances

Bhopal (Madhya Pradesh): After a long wait, the Madhya Pradesh government released its transfer policy on Wednesday. This mentions the special circumstances under which the government employees can get the transfer.

Barring the restriction period, generally transfer orders of first, second, and third class government servants can be issued only under the following exceptional circumstances after administrative approval from the departmental minister.

The government staff can avail themselves of a transfer in case of a serious medical issue. On the basis of immediate need arising out of serious illness such as cancer, paralysis, heart attack, stroke, etc.

In the sequence of such judicial decisions, there is no other legal option except compliance with the given order. But in such a situation, departmental disciplinary action should not be pending against the concerned officer/employee at the place being transferred.

Very serious complaint/serious irregularity/serious negligence of a government servant in which disciplinary proceedings have been initiated by the department under Rule 14 or 16 of the MP Civil Services (Classification, Control and Appeal) Rules, 1966 in violation of the MP Civil Services (Conduct) Rules, 1965.

Transfers made in such a manner that the Lokayukta Organisation/Economic Offences Investigation Bureau or the police register a criminal case against a government servant or initiate prosecution proceedings so as not to affect the investigation.
